2. Scope
These Terms of Use govern the use of railys.eu and related areas and services, including radio.railys.eu, where such services are provided by the operator.
By accessing or using the platform, users agree to these Terms of Use. If you do not agree to these Terms of Use, you must not use the platform.
These Terms of Use apply in addition to other legally required information, in particular the legal notice, the privacy policy and any further notices provided on the platform.
3. Nature and Purpose of the Platform
Railys.eu is a music, video, shorts, radio and media platform. The platform is intended for publishing, displaying, playing, linking, embedding, commenting on and managing music, videos, creative media content, radio content and related community features.
Railys.eu is not a political platform, not a political discussion forum, not a place for party-political advertising and not a place for ideological disputes. Political agitation, party propaganda, election advertising, extremist content, hate speech, incitement, harassment and deliberately provocative political conflicts are not permitted.
The operator is entitled to define the thematic focus of the platform and to reject, remove or restrict content that does not fit the purpose of the platform, violates these Terms of Use, violates applicable law or endangers peaceful and respectful use of the platform.
The operator reserves the right to modify, expand, restrict or discontinue content, features, categories, technical processes or parts of the platform at any time, provided that no mandatory statutory rights are affected.
4. Registration and User Account
Certain features of the platform may require registration. When registering, users must provide accurate and complete information.
Users are responsible for keeping their login credentials confidential and protecting them against unauthorized access. Activities carried out through a user account are generally deemed to fall within the responsibility of the respective user unless misuse occurred without the user's fault.
The operator may temporarily or permanently restrict, suspend or delete user accounts where there are indications of violations of these Terms of Use, applicable law or legitimate security interests.
5. Age Information, Youth Protection and Access Restrictions
Where technically implemented, age prompts, age information or other access restrictions may be used for individual content, features, uploads or account areas.
This does not automatically mean that the entire platform is intended exclusively for adults. The relevant function or specific content is decisive in each case.
Users must not publish, upload, link or embed content that violates applicable youth protection laws or is clearly unsuitable for children and young people, in particular pornographic, seriously harmful, violence-glorifying or otherwise development-impairing content.
6. Permitted Use
The platform may only be used in compliance with applicable law and these Terms of Use. In particular, users must not engage in any activity that interferes with, endangers or harms the platform, the operator, other users or third parties.
The platform must be used in a fair, respectful and appropriate manner. Comments, uploads, profile information, links and other contributions must respect the purpose of the platform as a music, media and community platform.
7. Prohibited Content and Conduct
The following content and conduct are prohibited on Railys.eu in particular:
- illegal content or content that violates applicable German or European law,
- political videos, political comments, political advertising, party propaganda, election advertising, ideological agitation or political campaign content,
- extremist, terrorist, anti-constitutional or violence-glorifying content,
- hate speech, incitement, threats, harassment, bullying, personal attacks or degrading statements against individuals or groups, regardless of political, religious, ideological or other background,
- racist, antisemitic, discriminatory, defamatory, abusive or deliberately inflammatory content,
- pornographic, sexually explicit, obscene or primarily sexually provocative content,
- content that glorifies, trivialises or promotes violence, self-harm, abuse, crime or serious harm,
- content that infringes third-party rights, including copyright, trademark, name, personality, privacy, data protection or other rights,
- uploads, links or embeds for which the user does not have the necessary rights, licences or permissions,
- malware, scripts, manipulations, phishing, fraudulent links or other technically harmful material,
- attempts to bypass security mechanisms, access restrictions, age restrictions or technical protection measures,
- spam, mass advertising, misleading affiliate content, fake profiles, scams or other abusive use,
- automated access by bots, scrapers, mass crawlers or similar systems unless expressly permitted,
- use of third-party accounts without authorization,
- any activity that causes unreasonable strain on the platform, its systems or its infrastructure.
The prohibition of political content applies neutrally and regardless of direction, party, ideology or viewpoint. Railys.eu may reject or remove such content in order to preserve the platform as a music, media and entertainment platform.
8. User Content
If users upload, embed, link, describe, comment on or otherwise publish content on the platform, they generally remain the owners of their rights to the extent such rights belong to them.
The user grants the operator a simple, non-exclusive, territorially unrestricted right to use the respective content to the extent necessary for the operation of the platform. This includes in particular displaying, playing, storing, technically processing, making publicly available, reproducing, converting formats, generating previews, embedding into platform features and promoting the platform.
This right of use generally ends once the respective content has been permanently removed from the platform, unless statutory retention obligations, legitimate interests, evidentiary obligations, technical backup copies or already completed lawful uses require otherwise.
Users represent that they hold all rights, licences, consents and permissions necessary to publish, upload, link or embed their content on the platform.
9. Responsibility for Content
Users are solely responsible for content they upload, link, embed, distribute, comment on or otherwise make available through the platform.
The operator generally does not fully review user content in advance. However, the operator is entitled to review, restrict or remove content where there are concrete indications of legal violations, violations of these Terms of Use or risks to the platform.
10. Sharing and Embedding Content
Publicly available content on Railys.eu may generally be shared or embedded, provided that this is done lawfully, does not infringe third-party rights, does not bypass technical protection measures and does not create a false impression of affiliation, support, partnership or official approval by Railys.eu.
When sharing or embedding content, source information, copyright notices, branding, logos, references to Railys.eu and other legal notices must not be removed, falsified or misleadingly altered.
The operator may restrict sharing, embedding or external access in individual cases where this is necessary or appropriate for legal, technical, security-related or rights-related reasons.
11. External Content and Third-Party Platforms
The platform may contain third-party content, embedded media, external links or references to third-party platforms, including audio, video or social media content.
Third-party providers are responsible for their own content and services. The operator does not automatically adopt third-party content as its own.
Users are responsible for checking the respective terms, privacy information and risks before accessing external links or services.
12. Reporting Infringements and Prohibited Content
If you believe that content on the platform violates applicable law, third-party rights or these Terms of Use, you may report it to: admin@railys.eu.
A report should include, where possible:
- a clear explanation of why the content is considered illegal or in breach of these Terms of Use,
- the exact URL or other precise location of the content concerned,
- the name and e-mail address of the reporting person, unless anonymous reporting is technically provided,
- a statement that the information provided in the report is accurate and complete to the best of the reporting person's knowledge.
The operator will review sufficiently substantiated reports within a reasonable time and may take appropriate measures where required or justified.
Abusive, knowingly false or repeatedly unfounded reports may be rejected and may in individual cases lead to restrictions on use.
13. Moderation, Restriction and Removal of Content
The operator may review, restrict, hide, block, remove or disable access to content. The operator may also restrict, temporarily suspend, permanently suspend or delete user accounts where there are concrete indications of violations of these Terms of Use, third-party rights, applicable law or the security and integrity of the platform.
Moderation decisions may be based on user reports, the operator's own review, technical security measures or legal requests. The operator does not use fully automated moderation decision-making unless expressly stated otherwise.
Depending on the severity of the case, possible measures include in particular: notice, warning, removal of content, restriction of visibility, disabling of comments, temporary account restriction, permanent account suspension, deletion of an account or reporting to competent authorities where legally required.
Where legally required and where electronic contact details are available, affected users will be informed of the main reason for a moderation decision.
There is no entitlement to publication of specific content or to permanent availability of particular platform features.
14. Availability
The platform is provided within the scope of technical and operational possibilities. Continuous, error-free or fully uninterrupted availability is not owed.
Maintenance, security updates, technical faults, further development or external influences may temporarily restrict availability.
15. Copyright and Intellectual Property of the Operator
Unless stated otherwise, the layout, structure, selection, compilation, labels, logos, designs and content provided by the operator are legally protected.
Any use beyond what is permitted by law requires prior consent from the respective rights holder.
The name Railys.eu, logos, marks, designs and other platform elements must not be used in a way that creates the impression of an official affiliation, approval, partnership or endorsement unless expressly permitted.
16. Liability
The operator shall have unlimited liability in cases of intent, gross negligence and injury to life, body or health.
In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for the contract. Material contractual obligations are obligations whose fulfillment makes the proper performance of the user relationship possible in the first place and on whose observance users may regularly rely.
In all other respects, liability is excluded to the extent permitted by law.
Responsibility for unlawful user content is governed by the statutory provisions. The operator is not obliged to generally monitor user content without a specific reason.
17. Indemnification
Users shall indemnify the operator against third-party claims arising from a culpable breach of these Terms of Use, unlawful content or infringement of third-party rights through the use of the platform. This also includes reasonable legal defense costs.
18. Term and Termination
If a user relationship exists through an account, it runs for an indefinite period. Users may delete their account at any time through the available functions or request deletion.
The operator may terminate user relationships with immediate effect for good cause or suspend accounts, in particular in the event of serious or repeated violations of these Terms of Use.
19. Privacy
Information on the processing of personal data is set out in the separate Privacy Policy.
20. Changes to these Terms of Use
The operator reserves the right to amend these Terms of Use with future effect where there is a valid reason to do so, in particular in the event of technical changes, new features, legal changes or adjustments to platform operations.
The current version will be published on the platform.
In the event of material changes, registered users may be informed in an appropriate manner where this is required or appropriate.
21. Applicable Law
These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions or other mandatory statutory provisions provide otherwise.
22. Place of Jurisdiction
If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with this user relationship shall be the operator's registered seat, to the extent permitted by law.
23. Contract Language and Language Versions
The German version of these Terms of Use is authoritative. An English translation may be provided for better understanding. In the event of discrepancies between the German and English versions, the German version shall prevail.
24. Severability
If any provision of these Terms of Use is or becomes wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall replace the invalid provision.
