2. Scope
These Terms of Use govern the use of railys.eu and related areas and services, including radio.railys.eu, where such services are provided by the operator.
By accessing or using the platform, you agree to these Terms of Use. If you do not agree to these terms, you must not use the platform.
3. Nature of the Platform
Railys.eu is a music, video, shorts, radio and media platform. The platform may display, stream, link, embed, upload, comment on or otherwise manage content.
The operator reserves the right to modify, expand, restrict or discontinue content, features, categories, technical processes or parts of the platform at any time, provided that no mandatory statutory rights are affected.
4. Registration and User Account
Certain features may require registration. When registering, you must provide accurate and complete information.
You are responsible for keeping your login credentials confidential and protecting them against unauthorized access. Activities carried out through your account are deemed to fall within your responsibility unless misuse occurred without your fault.
The operator may temporarily or permanently restrict, suspend or delete accounts where there are indications of violations of these Terms of Use, applicable law or legitimate security interests.
5. Age Information and Access Restrictions
Where technically implemented, age prompts, age information or other access restrictions may be used for individual content, features, uploads or account areas.
This does not automatically mean that the entire platform is intended exclusively for adults. The relevant function or specific content is decisive in each case.
6. Permitted Use
You may use the platform only in compliance with applicable law and these Terms of Use. In particular, you must not engage in any activity that interferes with or endangers the platform, the operator, other users or third parties.
7. Prohibited Content and Conduct
The following is prohibited in particular:
- unlawful, abusive, discriminatory, defamatory, hateful or misleading content,
- content that infringes third-party rights, including copyright, trademark, name, personality or data protection rights,
- uploading, distributing or linking malware, scripts, manipulations or other technically harmful material,
- attempts to bypass security mechanisms, access restrictions or technical protection measures,
- automated access by bots, scrapers, mass crawlers or similar systems unless expressly permitted,
- spam, mass advertising, misleading affiliate content or other abusive use,
- use of third-party accounts without authorization,
- any use that causes unreasonable strain on the platform or its infrastructure.
8. User Content
If you upload, embed, link, describe, comment on or otherwise publish content on the platform, you generally remain the owner of your rights to the extent such rights belong to you.
You grant the operator a simple, non-exclusive, territorially unrestricted right to use such content for the operation of the platform, including display, technical processing, making it publicly available, reproduction, format conversion, preview generation and promotion of the platform, to the extent necessary for platform operation.
This right of use generally ends once the content has been permanently removed from the platform, unless statutory retention obligations, legitimate interests or technical backup copies require otherwise.
9. Responsibility for Content
Users are solely responsible for content they upload, link, embed, distribute or otherwise make available through the platform.
You represent that you hold all rights, permissions and consents necessary to use and publish your content on the platform.
10. External Content and Third-Party Platforms
The platform may contain third-party content, embedded media, external links or references to third-party platforms, including audio, video or social media content.
Third-party providers are solely responsible for their own content and services. The operator does not automatically adopt third-party content as its own.
11. Reporting Infringements
If you believe that content on the platform violates applicable law or third-party rights, you may report it to admin@railys.eu.
Reports should include, where possible, precise details about the content concerned, its location and the alleged infringement so that it can be reviewed.
12. Moderation, Restriction and Removal of Content
The operator may review, restrict, suspend or remove content, or limit accounts, where there are concrete indications of violations of these Terms of Use, third-party rights, applicable law or the security and integrity of the platform.
There is no entitlement to publication of specific content or to permanent availability of particular platform features.
13. Availability
The platform is provided within the scope of technical and operational possibilities. Continuous, error-free or fully uninterrupted availability is not owed.
Maintenance, security updates, technical faults, further development or external influences may temporarily restrict availability.
14. Copyright and Intellectual Property of the Operator
Unless stated otherwise, the layout, structure, selection, compilation, labels, logos, designations and content provided by the operator are legally protected.
Any use beyond what is permitted by law requires prior consent from the respective rights holder.
15. Liability
The operator shall have unlimited liability in cases of intent, gross negligence and injury to life, body or health.
In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for the contract. Material contractual obligations are obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance users may regularly rely.
In all other respects, liability is excluded to the extent permitted by law.
16. Indemnification
You shall indemnify the operator against third-party claims arising from your culpable breach of these Terms of Use, unlawful content or infringement of third-party rights through your use of the platform. This also includes reasonable legal defense costs.
17. Term and Termination
If a user relationship exists through an account, it runs for an indefinite period. You may delete your account at any time through available functions or request deletion.
The operator may terminate user relationships with immediate effect for good cause or suspend accounts, in particular in the event of serious or repeated violations of these Terms of Use.
18. Privacy
Information on the processing of personal data is set out in the separate Privacy Policy.
19. Changes to these Terms of Use
The operator reserves the right to amend these Terms of Use with future effect where there is a valid reason to do so, in particular in the event of technical changes, new features, legal changes or adjustments to platform operations.
The current version will be published on the platform.
20. Applicable Law
These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
21. Place of Jurisdiction
If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with this user relationship shall be the operator's registered seat, to the extent permitted by law.
22. Severability
If any provision of these Terms of Use is or becomes wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall replace the invalid provision.
